Groundwater Conservation Districts in Texas: What Everyone Needs to Know One of the easiest contract details to overlook can also become one of the most important disclosures in a Texas real estate transaction: whether a property is located within a Groundwater Conservation District (GCD). What is a Groundwater Conservation District, you say? Groundwater Conservation Districts are local entities created to help manage and protect groundwater resources throughout Texas. Many D-FW counties fall within one of these districts, excluding only Dallas, Rockwall, Kaufman & Hunt counties. While the disclosure itself may seem straightforward, understanding when additional paperwork is required—and when it isn't—is essential for protecting property owners during a sale. Does every property require a separate groundwater disclosure? No. If a property: Is located within city limits, rReceives water from a municipality, Municipal Utility District (MUD), or Public Water Company (PWC), and does not have a private water well or pond, then a separate groundwater and surface rights disclosure is generally not required. However, the seller should be made aware so they may make the appropriate disclosure selection on TAR's property disclosure. One of the biggest risks occurs when a seller advises a buyer to complete paperwork differently than their understanding of the requirements. Be sure to document your conversations in writing—whether by email or text—and retain that documentation in a transaction file. The takeaway Real estate compliance isn't just about checking boxes—it's about documenting decisions, protecting your clients, and protecting yourself. For agents in doubt: Verify whether the property is located within a Groundwater Conservation District. Determine the property's actual water source. Document conversations that affect contract decisions. When necessary, seek clarification before proceeding. A few extra minutes of due diligence today can prevent unnecessary disputes tomorrow.
